The U. S. pharmaceutical company said Wednesday it had filed an appeal with the Supreme Court of New Jersey to allow it to bring a case under the False Claims Act against AstraZeneca in New Jersey to determine whether it is still entitled to a settlement for its own cost.
"The issue is whether the U. government is still under a patent on the drug," said Sidney M.ourney, attorney general for the District of New Jersey, who is the spokesman for the Federal Trade Commission.
The case was filed under the False Claims Act, which allows the federal government to issue a "judgment of nullity" on a case under the Act.
The United States argued that the company had been entitled to a settlement under the Act because the government could not prove that it is still eligible for a generic version of the drug's blockbuster drug.
In June, the New Jersey court ruled that the federal government was not eligible to allow generic versions of the drug's branded version of Nexium, the generic drug for heartburn, in the United States.
But the court also rejected the argument that the government could not prove that the drug was still eligible for a generic version of the drug because the government had not proved its case.
"It's not a case in which the government has made any evidence that is inadmissible and is not inadmissible in support of its position," said Justice John Marshall of the United States District Court for the Eastern District of Pennsylvania. "We will try to find that the government has the ultimate right to have the drugs in the United States, and not in this case."
The government argued that the court had found that the government had not established that it was eligible to apply for a settlement for Nexium.
But the court said it was unclear if that meant that the government could still be reimbursed for Nexium, which is marketed by AstraZeneca.
